Employment Compliance in Switzerland

Swiss employment is governed by the Code of Obligations and the Labor Act at federal level, with significant variation by canton and, in many sectors, by collective labor agreement. Social insurance runs through separate carriers for old-age and disability, unemployment, occupational pensions, accidents, and family allowances, each with its own registration and reporting. KOMP’s Global Compliance Engine maps every Swiss obligation to your workforce and keeps it current, from the first contract to the final payslip.

What Is an Employer of Record in Switzerland?

An Employer of Record (EOR) in Switzerland is a locally registered organization that becomes the legal employer of your Swiss workforce. It lets companies based anywhere hire people in Zurich, Geneva, Basel, Zug, or any other canton without forming a GmbH, AG, or branch. The EOR takes on the statutory employer duties, including compliant contracts, CHF payroll, social insurance registrations and contributions, occupational pension affiliation, accident cover, withholding tax where it applies, and lawful termination. You keep full control of the employee’s role, priorities, and performance.

This Model Works Especially Well When:

  • You want to hire senior or specialist talent in Switzerland without the cost of an entity
  • You are opening a European or EMEA presence and need a compliant base quickly
  • You need to convert a Swiss contractor into an employee without incorporating
  • You are building a distributed team and want one employment model across countries
  • You want to reduce exposure to Swiss social insurance, pension, and employment compliance risk
Komp delivers this as part of a single workforce platform, so your Swiss employees sit alongside contractors, EOR workers, and direct employees in other countries, governed by the same data, workflows, and controls.

How Komp’s Employer of Record Works in Switzerland

KOMP becomes the legal employer for your Swiss team members and takes on their statutory liabilities, while you run the work. Here is what that looks like in practice.

Market entry without entity setup

Skip company formation, notarization, capital deposit, the Swiss corporate bank account, and registration with a cantonal compensation office, a pension fund, and an accident insurer. KOMP’s existing Swiss infrastructure lets you make offers as soon as you find the right person.

Hire-to-retire lifecycle management

Komp Activate runs onboarding, contracts, and benefits; Komp PayOps runs monthly CHF payroll with social insurance and withholding tax filings; Komp TimeOps tracks attendance, leave, and working time; and compliant offboarding closes the loop, all in one flow.

One view across every country

Komp Workforce gives HR, Finance, and Legal a single source of truth for Swiss and global headcount, covering payroll status, employer contribution costs, pension credits, leave balances, and compliance alerts, with audit trails built in.

What Komp Handles Under EOR in Switzerland

KOMP manages every part of the Swiss employment relationship so your team can focus on the work, not the paperwork.

Compliant employment contracts

We issue contracts that meet the Code of Obligations and reflect the canton, the working language, and any applicable collective labor agreement, covering salary and any 13th month payment, working time, probation, holidays, notice, and confidentiality.

Digital onboarding and registrations

We collect the AHV social security number and personal data, register the employee with the cantonal compensation office, affiliate them with the pension fund and accident insurer, confirm permit status where relevant, and complete setup before the start date.

Payroll processing and salary disbursement

Komp PayOps calculates gross-to-net pay in CHF, applies all statutory deductions, handles 13th month and bonus payments correctly, and pays employees through our owned payment infrastructure with clear, compliant payslips.

Social insurance contributions

We calculate and remit AHV, IV, and EO at 10.6% of gross salary split equally between employer and employee, unemployment insurance at 2.2% split equally up to the annual ceiling, and the cantonal family allowance contribution, which employers fund.

Occupational pension (BVG) administration

We assess whether each employee meets the annual entry threshold of CHF 22,680, affiliate them with a pension fund, and process age-banded retirement credits on the coordinated salary, with the employer funding at least half of the total contribution.

Accident and sickness insurance

We arrange mandatory accident insurance, with occupational cover funded by the employer and non-occupational cover typically charged to the employee, and can administer daily sickness benefit insurance, which most Swiss employers offer.

Withholding tax and reporting

For employees subject to Quellensteuer, we apply the correct cantonal tariff based on residence, civil status, and income, remit it to the cantonal tax authority, and issue the annual salary certificate every employee needs for their tax return.

Offboarding and final settlement

We manage resignations and terminations with the correct notice under the Code of Obligations, respect protected periods such as illness, accident, pregnancy, and military service, pay out unused holiday, and complete the pension and insurance exit formalities.

Employer of Record vs Entity Setup in Switzerland

Criteria Employer of Record (KOMP) Own Swiss Entity
Best suited for Market entry, small senior teams, fast expansion, remote or hybrid roles Large, permanent Swiss operations such as a regional headquarters or research site
Time to hire As soon as the candidate accepts, no incorporation needed Company formation, capital deposit, banking, and social insurance registrations must be completed first
Upfront cost No setup cost; predictable per-employee fee Share capital, notary, commercial register, accounting, and payroll setup costs
Compliance ownership Managed by KOMP with AI-assisted monitoring and human review Your responsibility, requiring local HR, payroll, tax, and legal support across cantonal rules
Flexibility Scale up or down with minimal commitment Liquidating a Swiss company is slow and costly
Legal presence Not required, KOMP is the legal employer Full Swiss company with a locally resident director requirement and commercial register filings
Workforce visibility Swiss data unified with your global workforce in one platform Often a separate local system and vendor

Employer of Record Cost in Switzerland

EOR pricing in Switzerland varies by provider, service scope, and team size. The real comparison is not the fee alone, it is the fee against the time, overhead, and risk of running your own Swiss entity in a country where payroll touches five separate insurance systems. KOMP pricing is built around your actual workforce model. You pay a clear, predictable fee that covers employment administration, CHF payroll and statutory filings, pension and insurance administration, compliance monitoring, and support. There are no hidden charges, no FX markups on payroll, and no need to coordinate separate payroll, HR, and legal vendors.

What Shapes Your Price

  • Number and type of workers: employees, contractors, and EOR hires across your footprint
  • Countries and cantons of operation: Switzerland only or multi-country, and which cantons your people sit in
  • Compensation design: 13th month salary, bonuses, commissions, or equity
  • Benefits scope: pension cover above the statutory minimum, daily sickness benefit insurance, or supplementary health cover
  • Integrations and reporting: HRIS, ERP, and finance system connections

Why EOR Delivers Strong ROI

  • Faster revenue: your Swiss hire starts contributing sooner
  • Lower overhead: no incorporation, resident director arrangements, local accounting, or payroll software
  • Lower risk: fewer retroactive contribution assessments, withholding tax corrections, and misclassification exposures
  • Less admin: one platform, one invoice, one partner for Swiss employment

Who Should Use an EOR in Switzerland?

Startups and scale-ups going international

Place a senior commercial or technical hire in Switzerland without tying up capital in a subsidiary and validate the market before you commit.

Technology and deep tech companies

Hire engineering, AI, and data talent from the ETH Zurich and EPFL ecosystems while keeping your structure light.

Pharma, medtech, and life sciences

Build regulatory, clinical, quality, and commercial teams near the Basel and Lake Geneva clusters, with documentation handled properly.

Financial services, fintech, and commodities

Hire in Zurich, Geneva, and Zug for banking, asset management, trading, and digital asset roles that need a compliant local employment base.

HR and People leaders

Deliver a consistent employee experience across countries while KOMP absorbs social insurance, pension, and cantonal variation.

Finance and Operations leaders

Get predictable costs, consolidated invoicing, owned payment rails with zero FX markup, and audit-ready records for every Swiss hire.

Why Komp Is Different from Generic EOR Providers

Many providers can put a Swiss employee on payroll. KOMP is built as workforce infrastructure, combining AI intelligence, owned payment rails, and human governance so you can grow in Switzerland with confidence.

AI Agent Swarms with human control

Autonomous agents continuously check payroll, classification, contracts, and regulatory change across federal and cantonal rules. Recommendations are surfaced for review before anything is executed: autonomous intelligence, human control.

Worker classification intelligence

Our jurisdiction-based rules engine analyzes 50+ risk factors to help you decide whether a Swiss worker should be engaged as a contractor or an employee, which matters because Swiss compensation offices can reclassify independent status and assess contributions retroactively.

Owned payroll infrastructure

Komp PayOps runs on owned infrastructure with 135+ currencies, transparent flat fees, and no FX markups, so paying CHF salaries from a EUR, USD, or GBP budget costs exactly what you expect.

One platform, four modules

Komp Activate, Komp Workforce, Komp TimeOps, and Komp PayOps connect hiring, workforce records, time, and pay across Switzerland and 150+ countries.

Enterprise-grade security

AES-256 encryption, SOC 2 Type II, ISO 27001, GDPR compliance, role-based access control, and AWS hosting with multi-region redundancy protect your Swiss employee data, alongside Swiss data protection requirements.

Real-time visibility and reporting

Live dashboards for payroll status, fully loaded employment costs, leave balances, and compliance alerts, with exportable reports for Finance, HR, and audit.

Why Use an Employer of Record in Switzerland?

Switzerland combines a highly educated, multilingual workforce with strong research institutions, political stability, and some of the world’s leading finance and life-sciences clusters. An EOR makes entering it faster, safer, and lighter on overhead.

Hire without setup delays

Forming a Swiss company means statutes, capital, a commercial register entry, banking, and registrations with several insurance carriers before anyone can be paid. With KOMP, you can make offers and onboard without waiting for any of it.

Stay compliant from day one

Swiss obligations sit across federal law, 26 cantons, and sector collective agreements, and payroll runs through multiple carriers at once. KOMP keeps contracts, contributions, and filings current so errors do not accumulate quietly.

Control cost and overhead

Employer contributions typically add roughly 15 to 20 percent on top of gross salary before benefits. KOMP makes that cost visible and predictable, and removes the entity, accounting, and local HR overhead behind it.

Deliver a better employee experience

Accurate CHF pay, correct pension credits, proper insurance cover, clear payslips, and an annual salary certificate issued on time matter to Swiss employees, and shape whether strong candidates accept and stay.

Manage Switzerland like every other market

See Swiss headcount, costs, and compliance in the same platform as the rest of your global workforce. No separate vendor, no data silos.

Switzerland Employment Compliance: What Global Employers Must Manage

Swiss employers answer to cantonal compensation offices for social insurance, to pension funds and accident insurers for occupational cover, to cantonal tax authorities for withholding tax, and to labor inspectorates for working conditions. These are the areas that matter most, and how KOMP covers them.

Employment contracts and working time

Contracts are governed by the Code of Obligations, and written terms are strongly advised even where not strictly required. Maximum weekly working time is 45 hours for office, technical, and retail staff and 50 hours for most other sectors, with rules on overtime compensation and rest periods.

Wages and minimum pay

There is no federal minimum wage. Several cantons, including Geneva, Neuchâtel, Jura, Ticino, and Basel-Stadt, set their own statutory minimums, and collective labor agreements set binding minimum rates in many sectors. A 13th month salary is customary but is only owed when the contract provides for it.

Social insurance contributions

AHV, IV, and EO total 10.6% of gross salary with no ceiling, split equally between employer and employee. Unemployment insurance is 2.2%, also split equally, on salary up to CHF 148,200 a year. Family allowance contributions are set by canton and funded by the employer.

Occupational pension (BVG)

Employees earning above CHF 22,680 a year must be affiliated with a pension fund. Retirement credits are age-banded, rising from 7% of coordinated salary for employees aged 25 to 34 to 18% for those aged 55 and over, and the employer must fund at least half.

Accident and sickness cover

Accident insurance is mandatory. Occupational accident premiums are paid by the employer, while non-occupational premiums are usually deducted from the employee. Sick pay is owed under the Code of Obligations on a scale that grows with service, which is why most employers take out daily sickness benefit insurance.

Withholding tax (Quellensteuer)

Employees without a settlement permit, and cross-border workers, are generally taxed at source. Employers must apply the correct cantonal tariff and remit it and must issue an annual salary certificate to every employee.

Leave and public holidays

Employees are entitled to at least four weeks of paid holiday a year, and five weeks up to the age of 20. Maternity leave is 14 weeks paid through the income compensation scheme, and fathers or the other parent receive two weeks. Public holidays are set by canton, with 1 August the only nationwide holiday.

Termination and protected periods

Notice is seven days during probation, then one month in the first year of service, two months from the second to the ninth year, and three months thereafter, unless the contract provides otherwise. Terminations are blocked during protected periods such as illness, accident, pregnancy, and military service.

Work permits and immigration

EU and EFTA nationals benefit from free movement with a registration or permit procedure. Third-country nationals are subject to federal quotas and cantonal approval, with qualification and salary conditions, and permission must be in place before work starts.

Data protection

Employee data is governed by the revised Swiss Federal Act on Data Protection, and by the GDPR where your group processes EU data, with requirements on lawful processing, transparency, security, retention, and breach notification.

Switzerland is federal, and payroll follows the canton. Minimum wages, family allowance rates, withholding tax tariffs, and public holidays all change from one canton to the next, and a sector collective agreement can override the statutory baseline entirely. Contribution ceilings and pension thresholds are also reviewed periodically at federal level. KOMP’s AI Agent Swarms track federal and cantonal changes together and flag the payroll, contract, and policy updates your Swiss team needs.

Employer of Record Coverage Across Key Swiss Cities and Cantons

Swiss talent is concentrated in a handful of economic centers, each with its own sector profile, language, salary levels, and cantonal rules. KOMP lets you hire compliantly in any of them, with the same payroll, pension, and compliance workflows everywhere.

Employer of Record in Zurich

Switzerland’s largest city and financial capital, with deep talent in banking, insurance, asset management, software, and AI, supported by ETH Zurich. Salary levels are among the highest in Europe and competition for senior talent is intense.

Employer of Record in Geneva

A French-speaking hub for international organizations, private banking, commodity trading, and life sciences, with a cantonal minimum wage and its own withholding tax tariffs to apply correctly.

Employer of Record in Basel

The center of Swiss pharmaceuticals and life sciences, home to global headquarters and a dense supplier ecosystem, ideal for regulatory, clinical, quality, and R&D hires.

Employer of Record in Zug and Central Switzerland

A low-tax canton known for commodity trading, crypto and digital asset companies, and holding structures, with a strong international and English-speaking workforce.

Employer of Record in Lausanne and the Lake Geneva region

Anchored by EPFL, with strengths in medtech, biotech, robotics, and sports organizations, offering research-grade engineering and scientific talent.

Whether your Swiss team works in-office, hybrid, or fully remote, KOMP applies the right cantonal tariffs, contribution rates, and holiday calendars automatically, so adding a new canton never adds new compliance work for you.

Employer of Record in Switzerland: FAQs

It is a locally registered company that legally employs workers in Switzerland on your behalf, taking responsibility for contracts, payroll, social insurance, pensions, insurance cover, and compliance. You direct the employee’s work; the EOR carries the employer obligations, so you can hire without a Swiss entity.

No. With KOMP as your Employer of Record, you can hire in any canton without forming a GmbH or AG, depositing share capital, appointing a resident director, or registering with a cantonal compensation office and pension fund.

Because KOMP already has the legal, payroll, and insurance infrastructure in place, onboarding can begin as soon as your candidate accepts. Timelines usually depend on the notice period agreed with their current employer and, for third-country nationals, on permit approval.

On top of gross salary, employers typically add roughly 15 to 20 percent for AHV, IV and EO, unemployment insurance, the employer share of BVG pension credits, accident insurance, and cantonal family allowance contributions. The exact figure depends on the employee’s age, salary, and canton, and KOMP shows it per hire before you commit.

There is no federal minimum wage. Several cantons set their own statutory minimums, and collective labor agreements set binding minimum rates in many sectors. KOMP checks the cantonal and sector position for every role before an offer goes out.

Employees earning above CHF 22,680 a year must be affiliated with a pension fund. Contributions are calculated on the coordinated salary using age-banded rates, and the employer funds at least half. KOMP handles affiliation, calculation, and reporting.

Employees without a settlement permit, and cross-border workers, are generally taxed at source through Quellensteuer, using the tariff for their canton, civil status, and income. Everyone else files a personal tax return using the annual salary certificate KOMP issues.

No, it is customary rather than statutory. It is owed when the employment contract provides for it, and most competitive Swiss offers include it. KOMP builds it into the contract and the payroll calendar when you choose to offer it.

Unless the contract provides otherwise, notice is seven days during probation, one month in the first year of service, two months from the second to the ninth year, and three months thereafter. Terminations are blocked during protected periods such as illness, accident, pregnancy, and military service.

Yes. KOMP can employ Swiss nationals and EU or EFTA citizens under free movement rules and supports the permit process for third-country nationals, which is subject to federal quotas and cantonal approval.

An EOR reduces the risk because KOMP is the legal employer. However, what your employees do, for example habitually concluding contracts on your behalf, can still matter. We recommend reviewing higher-risk roles with your tax advisor.

Yes. KOMP manages EOR employees and contractors on one platform, and its classification intelligence helps you assess the risk that a compensation office would treat an independent contractor as an employee, and choose the right engagement model.

KOMP is SOC 2 Type II certified, ISO 27001 certified, and GDPR compliant, uses AES-256 encryption with role-based access control, and is hosted on AWS with multi-region redundancy, in line with Swiss and EU data protection expectations.
