Chinese law recognizes direct employment, licensed labor dispatch, and genuine service outsourcing. It does not have a category called Employer of Record. Any China arrangement is analyzed under one of those three headings regardless of what it is called, and a provider who cannot tell you which one applies to your hire has not thought about it. We will tell you, in writing, before you make an offer.
Social insurance and housing fund rates, contribution bases, floors, and ceilings are set city by city, not nationally, and they reset on their own local schedules. A Beijing hire and a Shenzhen hire on identical salaries carry materially different employer costs. Komp applies each city’s current figures rather than a single national percentage.
A judicial interpretation effective September 2025 voided any agreement or employee undertaking that social insurance need not be paid and gave employees who were short-contributed the right to resign and claim statutory severance. Back-payment does not cure it. Legacy arrangements built on waivers, minimum-base contributions, or enrollment after probation are now live exposure.
A written contract in Chinese is required within one month of the start date. Miss it and the employer owes double wages for the months that follow; pass a year without one and the contract is deemed open-ended. This is the most mechanical and most avoidable liability in Chinese employment, and it still catches foreign employers regularly.

Before Komp, we had no unified view of our contractors and EOR workforce. Today HR and Finance operate from the same real-time data.
Komp didn't just simplify global hiring. They gave us a command center for scaling internationally. Instead of waiting months to establish an entity, we onboarded talent compliantly in just days.
Komp gave us the compliance infrastructure to operate confidently across regulated markets, without increasing operational overhead.
As our international footprint expanded, maintaining consistency across workforce processes became challenging. Komp helped us establish a scalable framework that supports operational efficiency and compliance confidence.
We finally have systems of scale that move as fast as our product teams. KOMP didn’t just reduce admin burden, they gave us infrastructure we can actually build on.
Global hiring evolved from a cross-functional burden into a coordinated operating model. For the first time, HR, Finance, and Legal were looking at the same numbers in the same place.
An Employer of Record (EOR) in Hong Kong is a locally incorporated company that becomes the legal employer of your Hong Kong workforce. It lets companies based anywhere hire people in Central, Kowloon, or anywhere else in the territory without incorporating, appointing a licensed company secretary, opening a corporate bank account, or taking on an annual statutory audit.
The EOR takes on the statutory employer duties, including the employment contract, HKD payroll, MPF enrollment and contributions, employer tax returns, employees’ compensation insurance, statutory leave, the accruing severance and long service entitlement, and lawful termination. You keep full control of the employee’s role, priorities, and performance.
Komp delivers this as part of a single workforce platform, so your Hong Kong employees sit alongside contractors, EOR workers, and direct employees in other countries, governed by the same data, workflows, and controls.
Komp becomes the legal employer for your Hong Kong team members and takes on their statutory liabilities, while you run the work. Here is what that looks like in practice.
Skip incorporation and business registration, the licensed company secretary who cannot also be your sole director, the registered office, the corporate bank account that is the real bottleneck, the annual audit that applies to every Hong Kong company regardless of size, and the MPF scheme registration.
Komp Activate runs onboarding, contracts, and benefits; Komp PayOps runs HKD payroll with MPF; Komp TimeOps tracks working time and leave; and compliant offboarding, including notice, terminal payments within the statutory deadlines, and tax clearance where the employee is leaving Hong Kong, closes the loop in one flow.
Komp Workforce gives HR, Finance, and Legal a single source of truth for Hong Kong and global headcount, covering payroll status, fully loaded employer costs, accrued severance and long service liability, leave balances, visa expiry dates, and compliance alerts, with audit trails built in.
See How It Works →Komp manages every part of the Hong Kong employment relationship so your team can focus on the work, not the paperwork.
We issue contracts that meet the Employment Ordinance, which cannot be contracted out of: any term that reduces a statutory entitlement is void. Contracts are drawn with the continuous contract test in mind, because that test decides whether an employee qualifies for paid leave, holidays, sickness allowance, severance, and long service payment at all.
We enroll each new employee in an MPF scheme within the statutory window and contribute at the mandatory rate on relevant income between the statutory floor and ceiling. Below the income floor the employee need not contribute but the employer still must, which is a common payroll error. We also apply the exemptions correctly, including for employees under eighteen and over sixty-five.
Severance payment arises on redundancy after two years of continuous service, and long service payment arises after five years on most other terminations. Both are calculated as two thirds of monthly wages per year of service, subject to a wage cap and an overall maximum. Since offsetting was abolished for service from May 2025, this is an unfunded liability. Komp provisions it monthly and handles the government subsidy claim.
Hong Kong does not operate PAYE. Employees are assessed and pay salaries tax directly, which simplifies payroll considerably but removes the monthly prompt that would otherwise catch the departure reporting obligation described below. Komp PayOps runs payroll, pays MPF by the statutory deadline, and keeps the records the Inland Revenue Department expects.
We file the commencement notification when an employee starts, the annual employer return, and the cessation notification when they leave. Where an employee is about to leave Hong Kong, a separate return is due in advance and the employer must withhold payments for a period pending clearance. Releasing final pay early is one of the costlier routine errors a foreign employer makes here.
Hong Kong requires every employer to maintain employees’ compensation insurance covering all employees, with no small employer exemption. Komp maintains cover as part of being the employer of record rather than leaving it as a box for you to tick.
Komp TimeOps tracks paid annual leave scaling with service, statutory holidays which are on a phased increase through to 2030, rest days, sickness allowance with its accumulating sickness day mechanism, fourteen weeks of maternity leave with the government reimbursement scheme applied, and paternity leave.
Most terminal payments fall due within seven days of termination, with severance payment on a separate timetable following a written claim. Failure without reasonable excuse is a criminal offence rather than a civil matter. Komp settles on time and documents the grounds.
See How It Works →Hong Kong is one of the easiest places in the world to incorporate, so this comparison is more balanced than it would be in most markets. The question is not whether you can set up a company. It is whether the overhead makes sense for the team you are building.
| Criteria | Employer of Record (Komp) | Own Hong Kong Entity |
|---|---|---|
| Best suited for | One to five people, market entry, regional roles, contractor conversion | Five or more people, contracting with Hong Kong customers, regulated activity, or raising capital locally |
| Incorporation | Not required | Genuinely fast and cheap, with no resident director and no minimum capital |
| Time to first hire | As soon as the candidate accepts | Incorporation takes days, but a functioning entity takes months because of banking |
| Corporate bank account | Not required | The real bottleneck, routinely two to three months and sometimes refused |
| Annual audit | Not your obligation | Mandatory for every company regardless of size, with no small company exemption |
| Severance and long service | Provisioned and administered by Komp | Yours, accruing in cash since offsetting was abolished, and requiring a subsidy claim |
| Compliance ownership | Managed by Komp with AI-assisted monitoring and human review | Your responsibility, including MPF, employer returns, insurance, and company secretarial work |
| Exit | Offboard employees and stop | Deregistration with final audit and tax clearance takes six to twelve months |
These three are used interchangeably across the region, and the difference matters because it determines who carries employment liability.
| Question | Employer of Record | PEO / co-employment | BPO / outsourcing |
|---|---|---|---|
| Who legally employs the worker | The EOR, on its own payroll | Shared, which requires you to have a local entity | The BPO provider |
| Who directs the work | You | You | The provider, against a service level |
| Do you need a local entity | No | Yes | No |
| Do you choose the individual hired | Yes | Yes | Usually not |
| Where employment liability sits | With the EOR | Shared | With the provider |
| Best suited to | Building your own named team in Hong Kong | Augmenting an existing Hong Kong entity | Buying a managed function or process |
EOR pricing in Hong Kong varies by provider, service scope, and team size. The comparison worth running is not the fee against incorporation, because incorporation is cheap. It is the fee against the company secretary, registered office, annual audit, profits tax return, insurance, and MPF administration that every Hong Kong entity carries whether it employs one person or fifty, plus the months of banking delay before any of it can function.
The other number to understand is termination. Hong Kong’s recurring employer cost is low, a capped retirement contribution and nothing else. But severance and long service payment used to be absorbed by accrued retirement contributions through an offsetting mechanism, and that mechanism was abolished for service from May 2025. For anyone hired today it is a cash liability accruing from the first year, and a quote built only on the contribution percentage understates a Hong Kong hire materially.
| Cost line | Who pays | How it behaves |
|---|---|---|
| MPF contributions | Employer and employee | A matched percentage of relevant income between a statutory floor and ceiling, so the employer cost caps at a fixed monthly amount; below the floor the employee is excused but the employer is not |
| Severance and long service payment | Employer only | Two thirds of monthly wages per year of service, subject to a wage cap and an overall maximum, no longer offsettable against mandatory retirement contributions for service from May 2025 |
| Employees’ compensation insurance | Employer only | Compulsory for every employer with no small employer exemption, priced by payroll and occupational risk |
| Salaries tax | Employee only | No withholding at source; the employer reports rather than deducts, except where an employee is leaving Hong Kong |
Financial services is the single largest contributor to the Hong Kong economy, and the talent pool across banking, asset management, insurance, private equity, and fintech is deep. Place commercial, research, or operations staff without an entity while the regulated structure question is still open.
Hong Kong sits inside the Greater Bay Area with free movement of capital, no exchange controls, and a legal and accounting system that both mainland counterparties and international investors accept. For exposure to China without a mainland entity, it remains the structurally obvious base.
Build commercial, support, or delivery teams with English as the working language, no translation layer, and a full overlap with the Asian trading day plus a workable handover to Europe and the United States.
If someone works set hours on your systems with no other clients, the arrangement may be employment in substance. Reclassification brings backdated MPF with surcharges, statutory leave, and exposure to severance and long service entitlements calculated from the original start date.
Hong Kong rewards companies that incorporate when they are ready. An EOR covers the period before that, so the decision is made on evidence rather than forecast. Komp supports the transition when the case is made.
Get predictable costs, consolidated invoicing, severance and long service liability visible on the balance sheet rather than at exit, and audit-ready records for every Hong Kong hire.
Many providers can put a Hong Kong employee on payroll. Komp is built as workforce infrastructure, combining AI intelligence, owned payment rails, and human governance so you can grow in Hong Kong with confidence.
Autonomous agents continuously check payroll, classification, contracts, accruing termination liability, statutory deadlines, and regulatory change. Recommendations are surfaced for review before anything is executed: autonomous intelligence, human control.
Hong Kong is one of the easiest places in the world to set up a company, and a provider telling you otherwise will not survive your first legal review. If you are hiring five or more people, contracting with Hong Kong customers, or need a regulated license, incorporate. We will say so and help you transition.
Offsetting severance and long service payment against retirement contributions ended for service from May 2025. Most published guidance and most cost models have not been updated. Komp provisions the monthly liability, accounts for the split between pre- and post-transition service, and administers the government subsidy claim across its declining schedule.
The test that decides who qualifies for paid leave, holidays, sickness allowance, severance, and long service payment was rewritten with effect from January 2026, with a new aggregate hours route alongside the weekly test. It changes who is in and who is out, particularly for part-time and irregular-hours staff. Komp applies the current test.
AES-256 encryption, SOC 2 Type II, ISO 27001, GDPR compliance, role-based access control, and AWS hosting with multi-region redundancy protect your Hong Kong employee data, alongside Personal Data (Privacy) Ordinance obligations.
Komp Activate, Komp Workforce, Komp TimeOps, and Komp PayOps connect hiring, workforce records, time, and pay across Hong Kong and 150+ countries.
Start Hiring in Hong Kong →Hong Kong employers answer to the Labor Department for employment standards, to the Mandatory Provident Fund Schemes Authority for retirement contributions, and to the Inland Revenue Department for reporting. These are the areas that matter most, and how Komp covers them.
The Ordinance is the core statute and cannot be contracted out of, so any term reducing a statutory entitlement is void. Most substantive entitlements depend on the employee holding a continuous contract, and that test was rewritten with effect from January 2026. Alongside the existing weekly hours test there is now an aggregate hours route measured across a four-week period, which brings some part-time and irregular-hours staff inside entitlements they previously fell outside. The change is not retrospective.
Employer and employee each contribute a mandatory percentage of relevant income between a statutory floor and ceiling. Below the floor the employee is not required to contribute but the employer still is. Enrollment must happen within a short statutory window of the employee starting, and late enrollment or contribution attracts a surcharge and potential prosecution. Foreign employees working in Hong Kong are generally covered, with limited exemptions for short assignments and overseas scheme members.
Until May 2025 an employer could discharge severance and long service payment out of accrued benefits derived from its own mandatory contributions, so the cost was frequently absorbed. For service from that date, offsetting against mandatory contributions is no longer available. Service before the transition remains offsettable for employees already in post, with the wage figure for that portion fixed at the transition date so the legacy liability cannot grow. For anyone hired after it, the full liability sits with the employer in cash.
Severance arises where an employee with at least two years of continuous service is dismissed by reason of redundancy or laid off. Long service payment arises after five years on most other terminations, including resignation at retirement age or on certified ill health, and on death in service. Both use the same formula of two thirds of monthly wages per year of service, subject to a wage cap and an overall maximum, and an employee can never receive both for the same period.
A twenty-five-year subsidy scheme operates alongside the abolition, sharing post-transition severance and long service costs between the employer and the government through a portal claim. The employer always pays a share, the government share declines each year, and the relief falls away entirely for larger accumulated amounts after the early years. It softens the change rather than remove it.
Hong Kong does not operate withholding at source for ordinary employees, who are assessed and pay directly. The employer’s obligations are reporting ones: a notification when an employee starts, an annual employer return, a notification on cessation, and, where an employee is about to leave Hong Kong, an advance return coupled with an obligation to withhold payments for a period pending clearance. Because there is no monthly deduction, the departure obligation is easy to miss.
Every employer must maintain insurance covering liability for employees’ work injuries, with no exemption for small employers. Operating without cover is an offence carrying a substantial fine and possible imprisonment, and the employer remains liable for uninsured claims.
Statutory holidays are on a phased increase that aligns them fully with general holidays by 2030, so the entitlement rises in steps rather than staying fixed. Paid annual leave scales with length of service. Sickness allowance is payable at a proportion of wages where the employee has accumulated enough sickness days and produces a medical certificate. Maternity leave runs to fourteen weeks with a government reimbursement scheme covering part of the employer cost, alongside paternity leave.
Hong Kong has an hourly minimum wage that moved from ad hoc review to a formula-driven annual mechanism, with a new rate taking effect each May. The formula is floored so the rate can never fall and never rises by less than inflation. Employers must record total hours worked for employees below a monthly wage threshold, which itself moves with the rate.
Either party may terminate on notice or payment in lieu, and no reason is required for the termination itself, which makes Hong Kong comparatively straightforward by regional standards. Notice is a month where the contract is silent, with shorter periods during probation. Summary dismissal is available on narrow grounds and is construed strictly. Terminal payments are due within a short statutory window, and failure without reasonable excuse is a criminal offence.
Separate from the right to terminate on notice, the Ordinance provides claims for unreasonable dismissal where an employee with sufficient service is dismissed without a valid reason, for unreasonable variation of contract terms, and for unreasonable and unlawful dismissal where a statutory restriction is also breached, such as dismissing a pregnant employee or one on paid sick leave. For that last category the tribunal may order reinstatement without the employer’s agreement, which was not the position before 2018.
Hong Kong applies a multi-factor test looking at control, integration, provision of equipment, financial risk, and the parties’ intentions, and looks at substance rather than labels. A misclassified contractor brings backdated MPF with surcharges, statutory leave, and exposure to severance and long service entitlements calculated from the original start date.
The Change That Reset the Hong Kong Cost Model
Severance in Hong Kong used to be largely free. Since May 2025 it has not, and most cost models have not caught up. For decades a Hong Kong employer could discharge its severance and long service payment obligations out of the accrued benefits derived from its own mandatory retirement contributions. The money had already been set aside, so in practice the termination cost was frequently absorbed rather than paid. That offsetting arrangement was abolished for service from May 2025.
The effect depends on when someone was hired. For an employee already in post before the transition, service up to that date remains offsettable and the wage figure used for that portion is fixed at the transition date, so the legacy liability is capped and cannot grow with later pay rises. For anyone hired after it, every year of service accrues severance or long service payment in cash, calculated as two thirds of monthly wages per year subject to a wage cap and an overall maximum, with no offset available at all.
A government subsidy scheme shares the post-transition cost over a twenty-five- year period, but the employer always pays a share, and the government share declines every year. The practical consequence is that Hong Kong remains one of the lightest-touch employment regimes in any developed market monthly, while its termination cost has structurally increased.
It is also now an accounting matter rather than a cashflow one, because the obligation should be provisioned rather than expensed on exit. Any Hong Kong quote built purely on the retirement contribution percentage is describing the market as it was before May 2025.
Hong Kong is compact enough that location rarely changes the compliance position, but it changes the talent profile and the cost base considerably. Komp employs all of it on the same terms.
The financial core, home to the banks, asset managers, insurers, law firms, and regulators. The natural location for front-office, legal, compliance, and senior commercial roles, and the most expensive office market in the territory.
The established back-office and corporate corridor, widely used for operations, technology, and shared service functions that need Hong Kong Island without a Central address or a Central rent.
The redeveloped commercial district across the harbor, absorbing technology, creative, logistics, and corporate functions relocating out of the traditional business areas.
Trading, retail, media, and professional services, with strong cross-border connectivity through the high-speed rail terminus into the Greater Bay Area.
The two dedicated technology clusters, covering research and development, electronics, biotechnology, fintech, and digital media, each with its own ecosystem of startups and corporate research teams.
It is a locally registered company that legally employs workers in Thailand on your behalf, taking responsibility for the employment contract, THB payroll, tax withholding, Social Security and Workmen’s Compensation, the Employee Welfare Fund, statutory leave, severance, and lawful termination. You direct the employee’s work; the EOR carries the employer obligations, so you can hire without a Thai entity.
Yes, through an Employer of Record. Setting up your own Thai entity means company registration, a decision about ownership structure because foreign majority ownership of service businesses is restricted, registered capital, tax and VAT registration, and separate employer registrations. An EOR removes that from the critical path.
Because Komp already holds the Thai entity and the employer registrations, onboarding starts as soon as your candidate accepts. The timeline is then driven by contract execution and agency enrollment rather than by company registration on your side. Where a foreign national needs a work permit, immigration processing sits on the critical path and should be planned for separately.
Statutory severance is payable on any employer-initiated termination without one of the narrow statutory grounds, including redundancy and poor performance. It rises in bands with continuous service and reaches four hundred days of wages at twenty years, and it is calculated on the final wage rate including regular fixed allowances rather than base salary alone. Employees with less than a short qualifying period of service are outside the scale. Komp accrues it monthly, so it is visible throughout rather than arriving at exit.
Only on a closed statutory list, covering dishonesty or an intentional criminal offence against the employer, intentionally causing loss, gross negligence causing serious loss, breaching work rules after a valid written warning, unjustified absence for three consecutive working days, and imprisonment under a final judgment. Critically, the reason must be stated at the time of dismissal; a ground not given then cannot be relied on afterwards, and severance becomes payable.
Yes, and Komp runs the process properly. Notice is required or payment in lieu, which must be made on the termination date itself, with other sums settled within a short statutory window. Statutory severance applies unless one of the narrow exceptions is both available and correctly documented at the time. A separate unfair termination claim can also be brought, so a dismissal that complies with the statute can still be challenged as unreasonable.
It is the national scheme covering sickness, maternity, invalidity, death, child allowance, old age, and unemployment. Employer and employee each contribute a matched percentage of a capped monthly wage base, so the contribution flattens above a modest salary. The ceiling rose in January 2026 under a published multi-year schedule, and further increases are already legislated for later years.
It is a fund under the Labor Protection Act that began collecting contributions in October 2026 from employers at or above a headcount threshold. Both employer and employee contribute a modest rate applied to the full monthly wage with no ceiling. Employers operating a qualifying provident fund or an equivalent termination benefit scheme are exempt. It is the newest obligation in Thai payroll and the one most missed in configurations set up before late 2026.
Maternity leave was extended and the number of days paid by the employer increased, a new paid leave was introduced for parents of a newborn with medical complications, a further paid leave was created to support a spouse around childbirth, coverage was extended to certain individuals engaged under service contracts with public bodies, and the annual employment conditions report for larger employers moved to a prescribed digital filing.
Social Security and Workmen’s Compensation contributions, the Employee Welfare Fund where applicable, paid annual leave at a statutory minimum that most employers improve contractually, paid sick leave, paid personal business leave, public holidays, maternity leave with a defined employer-paid portion, and the two newer parental leave entitlements added in December 2025. Severance is a statutory entitlement on termination rather than a benefit, but it belongs in any honest cost model.
It depends on the role, and we will give you a straight answer before you make an offer. Thailand requires the employing entity to hold registered capital for each work permit it sponsors and to employ four Thai nationals for each foreign employee, and the role must genuinely sit within that entity’s registered business activities. An Employer of Record does not remove those requirements, it carries them. Investment promotion is the only route that genuinely lifts both tests, and that is a route for your own entity rather than for an EOR.
It reduces the risk but does not remove it, and any provider claiming otherwise is overstating the position. Permanent establishment turns on tax rules, principally whether you have a fixed place of business in Thailand or a dependent agent habitually concluding contracts on your behalf, not on who administers payroll. EOR employing engineering or support staff carries low exposure; one employing a country manager with authority to bind your company carries more. Komp will flag where a role sits on that line before you hire.
It can be. Thai authorities and courts look at the substance of the relationship rather than the label on the contract, and a person working set hours under your direction with no other clients may be an employee in law. Reclassification brings retroactive contributions and, on termination, the full statutory severance scale calculated from the original start date. Converting through an EOR closes the exposure on a controlled timeline.
Komp is SOC 2 Type II certified, ISO 27001 certified, and GDPR compliant, uses AES-256 encryption with role-based access control, and is hosted on AWS with multi-region redundancy, aligned to Personal Data Protection Act expectations.
De-risk your global expansion. Komp automates international hiring, compliant payroll, and localized benefits in 150+ countries for you to focus on scale, not bureaucracy.
